Residency Requirements

At least one of the spouses must meet the relevant New Mexico residency requirements to file for a divorce within the state. Thus, either spouse must reside in New Mexico for at least six months immediately preceding the date of the filing for divorce and have a domicile in the state. Domicile means that the person considers the state as their permanent home and is not going to move to another state in the foreseeable future.

Couples with minor children of the marriage must meet the same requirements.
